I9Everywhere ("I9Everywhere," "we," "us," or "our") is a service of PointHR Incorporated. This Privacy Policy explains how we collect, use, process, disclose, retain, and protect Personal Data when individuals use I9Everywhere websites, applications, and related services (collectively, the "Service").

We process Personal Data to provide the Service, support our customers' employment eligibility verification processes, comply with applicable legal obligations, maintain the security and integrity of the Service, and for the other purposes described in this Privacy Policy.

This Privacy Policy does not replace an employer's own privacy notices or obligations. In many circumstances, we process Personal Data on behalf of an employer or other customer that determines why the information is processed.

Information We Collect

We collect information provided directly by users, information provided by or on behalf of our customers, information generated through use of the Service, and information necessary to perform employment eligibility verification and related services.

Personal and Employment Eligibility Information

Depending on the Service being used, Personal Data may include:

  • Name, email address, telephone number, mailing or residential address, and other contact information.
  • Date of birth and other identifying information.
  • Social Security number, where applicable to the service or process being performed.
  • Citizenship, immigration, work-authorization, and employment eligibility information.
  • Government-issued identification and document information, including document type, issuing authority, document number, expiration date, and related data.
  • Images or copies of documents submitted for Form I-9, E-Verify, or related verification purposes.
  • Employment-related information and information supplied by an employer or authorized representative.
  • Electronic signatures, attestations, dates, timestamps, audit-trail information, and workflow records.
  • Other information submitted or generated in connection with Form I-9, E-Verify, or the Service.

Usage and Technical Data

We may collect information about how the Service is accessed and used, including IP address, browser type and version, device and operating-system information, pages or functions accessed, date and time of access, session information, unique device identifiers, diagnostic data, security events, and other usage information.

Cookies and Similar Technologies

We use cookies and similar technologies as necessary to operate, secure, and support the Service and, where applicable, to remember preferences and analyze service performance. Users may be able to control cookies through browser settings; however, disabling necessary cookies may prevent portions of the Service from functioning correctly.

  • Session cookies, used to operate authenticated sessions and Service functionality.
  • Preference cookies, used to remember settings and preferences.
  • Security cookies and similar technologies, used to help protect accounts, users, and the Service.

How We Use Personal Data

We may use Personal Data for the following purposes:

  • To provide, operate, maintain, secure, and support the Service.
  • To facilitate Form I-9 completion, employment eligibility verification, E-Verify processing, and related customer workflows.
  • To validate information and identify missing information, inconsistencies, potential data-entry errors, or other issues requiring user review.
  • To provide customer care, technical support, and service communications.
  • To maintain audit trails, transaction records, security logs, and other records associated with the Service.
  • To detect, prevent, investigate, and address fraud, misuse, security incidents, prohibited activity, and technical issues.
  • To comply with legal, regulatory, contractual, and governmental requirements.
  • To analyze and improve the operation, reliability, security, and functionality of the Service.
  • To use automated and artificial intelligence-assisted tools as described below.

Artificial Intelligence and Automated Processing

I9Everywhere uses artificial intelligence and automated technologies to assist users in identifying potential data-entry errors, inconsistencies, missing information, and validation issues within the Service. These technologies may process Personal Data when necessary to provide this functionality, but they are used to support user review rather than to replace or substantially replace human decision-making.

We use third-party artificial intelligence service providers, including Google, to provide certain AI-assisted functionality. Information submitted to these providers is processed subject to our commercial service arrangements, service configurations, and their applicable privacy, data-protection, and security terms. We configure and use these services to support Service functionality, security, abuse monitoring, and operational purposes, and not to permit Personal Data submitted through I9Everywhere to train general-purpose artificial intelligence models.

We do not permit Personal Data submitted through I9Everywhere to be used to train general-purpose artificial intelligence models.

Our AI service provider may temporarily retain information for limited operational, security, fraud-prevention, or abuse-monitoring purposes in accordance with its applicable commercial service terms and our service configuration. We seek to limit the Personal Data provided to AI services to information reasonably necessary for the AI-assisted function being performed.

I9Everywhere does not use artificial intelligence to independently make hiring or employment decisions, predict employee behavior, determine employment eligibility, or create risk profiles. AI is used as an assistive tool to identify potential errors, inconsistencies, missing information, or validation issues and to provide information or guidance for review by users.

AI-generated information may be incomplete or inaccurate and is not intended to replace legally required review, attestation, or decision-making by an employer, employee, authorized representative, or governmental agency.

We do not sell Personal Data for monetary consideration. We do not share Personal Data for cross-context behavioral advertising as those terms are defined under applicable California privacy law. If our practices change, we will update this Privacy Policy and provide any required opt-out mechanisms.

How We Share Personal Data

We may disclose Personal Data as necessary to provide the Service and for the purposes described in this Privacy Policy, including to:

  • PointHR companies, personnel, contractors, and service providers that support the Service.
  • Our customers, including employers and other organizations with which the individual has a direct relationship.
  • Governmental and regulatory bodies, including, where applicable, U.S. Citizenship and Immigration Services (USCIS), the Department of Homeland Security (DHS), Immigration and Customs Enforcement (ICE), and the Social Security Administration (SSA).
  • Technology, hosting, security, communications, and artificial intelligence service providers that process information on our behalf.
  • Professional advisers, auditors, insurers, and other parties as reasonably necessary for legal, compliance, security, or business purposes.
  • Other parties when required by law, legal process, or a valid governmental request, or when reasonably necessary to protect rights, safety, security, or the integrity of the Service.

Service providers are authorized to access Personal Data only as necessary to perform services for us and are subject to applicable contractual, confidentiality, privacy, and security obligations.

Data Retention

We retain Personal Data for as long as reasonably necessary to provide the Service, satisfy customer and contractual requirements, maintain required records and audit trails, comply with legal and regulatory obligations, resolve disputes, enforce agreements, and protect the security and integrity of the Service. Retention periods may vary depending on the type of information, the Service provided, customer instructions, and applicable law.

Certain third-party service providers, including AI service providers, may temporarily retain information for limited operational, security, fraud-prevention, or abuse-monitoring purposes under their applicable commercial terms and service configurations.

Data Security

We maintain administrative, technical, and physical safeguards designed to protect Personal Data against unauthorized access, use, alteration, loss, or disclosure. No method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

Transfers and Processing Locations

Personal Data may be processed and maintained in the United States and in other locations where we or our service providers operate. Where required, we use appropriate contractual or other safeguards for transfers of Personal Data across jurisdictions.

Legal and Regulatory Disclosures

We may disclose Personal Data when we believe in good faith that disclosure is necessary to:

  • Comply with applicable law, regulation, legal process, subpoena, court order, or governmental request.
  • Protect and defend the rights, property, or security of I9Everywhere, PointHR, our customers, users, or others.
  • Prevent, detect, or investigate fraud, security incidents, misuse, or possible wrongdoing involving the Service.
  • Protect against legal liability or respond to an emergency involving safety or security.

We collect and use Sensitive Personal Data only as reasonably necessary to provide the Service, support employment eligibility verification and related workflows, maintain security and integrity, comply with legal obligations, and for other permitted purposes under applicable law. We do not use Sensitive Personal Data to infer characteristics about individuals except where permitted by law and necessary for the Service.

Privacy Rights and Choices

Depending on the individual's location and applicable law, an individual may have rights concerning Personal Data, which may include rights to request access, correction, deletion, or other information about processing. Some rights may be limited where the information must be retained or processed to comply with employment eligibility verification, recordkeeping, security, contractual, or other legal requirements.

Where we process Personal Data on behalf of an employer or other customer, requests concerning Personal Data may need to be directed to that employer or customer. We may assist our customer in responding to a request where appropriate.

Where processing is based specifically on consent and applicable law provides a right to withdraw that consent, consent may be withdrawn by contacting us. Withdrawal does not affect processing that occurred before withdrawal and does not prevent processing based on another lawful basis.

Requests may be submitted using the contact information below. We may need to verify the request and the requester's authority before responding. If we process the relevant Personal Data on behalf of an employer or other customer, we may direct the individual to that customer or assist the customer in responding as appropriate. Authorized agents may submit requests where permitted by applicable law, subject to verification and proof of authorization.

Children's Privacy

The Service is intended for employment and workforce-related purposes and is not directed to children for general consumer use. We do not knowingly collect Personal Data from children except where information is lawfully processed in connection with an employment, work-authorization, or other permitted workforce process. If you believe Personal Data has been submitted inappropriately, please contact us.

Links to Other Sites

The Service may contain links to websites or services that are not operated by us. Their privacy practices are governed by their own policies. We are not responsible for the privacy practices or content of third-party websites or services that we do not control.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated Privacy Policy and revise the effective date above. Where required or appropriate, we may also provide notice through the Service, by email, or by another reasonable method before a material change becomes effective.
